What Is A Notary Public?

A Notary Public is a public servant with statewide jurisdiction who is authorized to take acknowledgments, protest instruments permitted by law to be protested (primarily negotiable instruments and bills and notes), administer oaths, take depositions, and certify copies of documents not recordable in the public records.  The primary duty of a Notary Public is to show that a disinterested party (the Notary Public) has duly notified the signer of an instrument as to the importance of such document, and the signer of such document has declared that the signer's identity, signature, and reasons for signing such instrument are genuine.  A Notary Public MAY NOT perform acts which constitute the practice of law, which would consist of preparing, drafting, selecting, or giving advice concerning legal documents.

What Documents Can Be Notarized?

The following are a list of documents that can be notarized:

  • Real Estate Documents (deed, deed of trust, etc.)
  • Financial Documents (mortgages, loan agreements, promissory notes, etc.)
  • Estate Planning Documents (wills, trusts, etc.)
  • Business Documents (bylaws, operating agreements, stock certificates, company forms, etc.)
  • Purchase Agreements and Contracts
  • Legal Documents (power of attorney, civil forms, etc.)
  • Immigration Documents (visa applications, etc.)
  • Personal Documents
  • Affidavits, Oaths and Other Acknowledgements

 

The following are a list of documents that can not be notarized:

  • No publicly recorded documents or photocopies/copies of public record documents including birth certificates, death certificates, and marriage licenses, divorce decrees, etc.
  • No government-issued documents such as  passports, visas, diplomas, school transcripts, etc.
  • No incomplete documents with blanks that aren't filled in
  • No documents in languages other than English
  • No documents without a notary certificate (phrasing needed for a notarization to occur)
  • No documents where the person is not physically present when the document is being notarized
  • No certification of verbal oaths, affirmations, or depositions.
  • No I-9 Form (Employment Eligibility Verification)

Acceptable Forms of ID Needed

All individuals seeking notarization, as well as any witnesses, must provide the notary with a current, valid, unexpired photo identification issued by a state or federal government agency that includes photo and signature. Acceptable forms of identification include:

  • Valid Driver’s License or ID card issued by any US state or territory
  • US military identification card
  • US passport issued by the US Department of State
  • US work visa or student visa
  • Tribal identification card
  • Permanent resident documentation (green card)
  • State-issued gun license
  • Foreign-issued passports with specific US Department of State documentation
